This Statement of Privacy applies to www.cloudbench.net, our social media properties, and Cloudbench’s privacy practices regarding data collection and usage. For the purposes of this Privacy Policy, unless otherwise noted, all references to Cloudbench include www.cloudbench.net. By using the Cloudbench website or by interacting with its social media accounts, you consent to the data practices described in this statement. This policy appears on our website and is referenced in our social media profiles. 

 

Cloudbench provides AI & cloud computing consulting services that help its customers implement solutions to complex business challenges. 

  1. Information We Collect or Process.

a)     Personal Information We Collect.

                                      i.        Cloudbench collects contact information so that we can create and manage customer accounts. For instance, Cloudbench collects personal information about representatives and contacts at its customer organizations, including their contact information (name, address, telephone numbers, and email addresses), job title, and name of employer. We also collect similar contact information about representatives of our vendors and business partners. 

                                     ii.        Cloudbench also receives personal information that you provide it at in-person meetings, by email, social media messages, or other communications, or by posts or other interactions with its social media accounts. Our website also includes by which you can submit your name and email address to be included in our email list to receive our newsletter. 

                                    iii.        Cloudbench may keep track of the websites and pages our users visit within Cloudbench for the purposes described in Section 2(a) below.

b)    Non-Personal Information We Collect.

                                      i.        Information about your computer hardware and software may be automatically collected by Cloudbench. This information can include browser type, domain names, access times and the URLs of pages within the Cloudbench website. This information is non-personal information because it is not associated with individual identities. 

                                     ii.        When we receive payments for our services, we have access to business customers’ payment information. Because the payment information is not associated with any individual, including a representative of the customer.

c)     Personal Information We Process for Customers.

                                      i.        Cloudbench provides cloud computing consulting services and acts as a reseller and sales partner to providers of cloud computing services. When implementing cloud computing services, Cloudbench may have access to or otherwise process personal information on behalf of customers. Our customers, or their customers or partners are the “controllers” of that personal information in that they have a direct relationship with the individuals whose personal information is processed, they collected the personal information, and they oversee the privacy practices relating to that personal information. 

                                     ii.        Cloudbench is a “processor” of customers’ personal information. When Cloudbench processes personal information on behalf of customers, it strictly follows the instructions of the customers about what to do with the personal information. With certain exceptions, Cloudbench has an obligation under its agreements with its customers not to disclose or otherwise transfer data to any third party except to provide our services or the customer has instructed us to disclose or transfer the information. Except as noted in Section 2 below, Cloudbench processes any personal information solely for the purpose of delivering services to our customers. 

  1. Uses of Information.

a)     Uses of Personal Information We Collect.

                                      i.        We will obtain personal information for communicating with customer representatives in relation to services and/or products they have requested from us and to fulfill our agreements with customers. We use the contact information of vendors and business partner representatives to communicate in connection with our business relationships with them or fulfill our agreements with them. 

                                     ii.        From time to time, Cloudbench may contact customer or business partner representatives, including newsletter subscribers, via email for the purpose of providing announcements, promotional offers, alerts, confirmations, surveys, and/or other general communication. In order to improve our Services, we may receive a notification when they open an email from Cloudbench or click on a link in the email. 

                                    iii.        Cloudbench uses information about usage of its website in order to determine what Cloudbench services are the most popular. This data is used to deliver customized content and advertising within Cloudbench to customers whose behavior indicates that they are interested in a particular area.

b)    Uses of Non-Personal Information We Collect.

                                      i.        Non-personal information described in Section 1(b) above is used for the operation of the website, to maintain quality and to provide general statistics regarding use of the Cloudbench website. 

                                     ii.        We use our customers’ business payment information for processing payments for our services.

c)     Uses of Personal Information We Process for Customers.

                                      i.        Cloudbench uses personal information processes for customers solely for the purpose of providing services to our customers, except as noted in Section 4 below.

a)     Cookies may be automatically used to collect specific information from a computer or mobile device that accesses and navigates through the Cloudbench website over time. Information collected by cookies may include information to help improve and customize the content or layout of the website. 

b)    A cookie is a small text file that websites save on a computer’s storage device when a website is visited. Cookies cannot be used to run programs or deliver viruses to the computer or mobile device accessing the Cloudbench website. Users can establish or change their browser settings to refuse cookies. However, the cookies used on the Cloudbench website are essential. Therefore, refusing cookies may interfere with the full functionality of the Cloudbench website and limit the user experience. 

  1. Disclosing or Sharing Information with Third Parties

a)     Personal Information Cloudbench Collects. 

                                      i.        Cloudbench may share data with trusted partners to help perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. For instance, we may store your personal information on servers provided by third party hosting vendors with whom we have contracted. All such third parties are prohibited from using your personal information except to provide these services to Cloudbench, and they are required to maintain the confidentiality of your information in accordance with this privacy policy. 

b)    Non-Personal Information Cloudbench Collects.

                                      i.        We also may share aggregate or anonymous information collected about website usage, as long as the information does not identify any specific individuals. 

c)     Personal Information Processed on Behalf of Our Customers. 

                                      i.        When providing AI & cloud computing solutions to our customers, we may facilitate storage, maintenance, and transmission of our customers data, including personal information, using our cloud computing service provider partners. The agreements between our customers and the cloud computing solution partners require that the service providers maintain the confidentiality of customer data, use customer data only for purposes of delivering their services to customers, not disclose customer data without authorization (except for reasons such as those described in subsection (d) below), and adhere to applicable data protection laws. 

d)    Other Circumstances for Disclosing Personal Information. 

                                      i.        From time to time, we may be required to respond to a subpoena, court order, search warrant, administrative or judicial process, requests by law enforcement agencies, or other requests that we must respond to under applicable law. We may disclose your personal information in response to any of these requirements. Also, we may disclose your personal information to preserve the security of our website or social media accounts, resolve disputes, or to assess any possible wrongdoing; (b) protect and defend the rights or property of Cloudbench; and/or (c) act under exigent circumstances to protect the personal safety of users of Cloudbench, or the public. 

                                     ii.        We may share or transfer personal information about you in connection with a merger, acquisition, reorganization, or sale of assets of our business, in the event of bankruptcy, or during the negotiations leading to such an event. We will seek assurances from any buyer that your personal information will be used, shared, maintained, and disclosed consistent with the terms of this privacy policy. 

e)    No Other Sharing or Disclosure. 

                                      i.        Except as listed above, we will not sell, distribute, transfer, or lease your personal information to third parties.

a)     This website contains links to other sites, which have their own privacy policies. Please be aware that we are not responsible for the content or privacy practices of such other sites. We encourage our users to be aware when they leave our site and to read the privacy statements of any other site that collects personally identifiable information. 

  1. Security of your Personal Information

a)     Cloudbench secures personal information and customer data from unauthorized access, use, or disclosure using reasonable and appropriate industry standard administrative, physical, and technical safeguards. Cloudbench uses encryption to protect personal information for both data in transit and at rest.

b)    When personal information (such as a credit card number) is transmitted to other websites, it is protected through the use of encryption, such as the Transport Layer Security (TLS) protocol. While we strive to take reasonable and appropriate security measures to protect against unauthorized access to or alteration of your personal information, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, you acknowledge that:

                                      i.        there are security and privacy limitations inherent to the Internet which are beyond our control; and 

                                     ii.        the security, integrity, and privacy of any and all information and data exchanged between you and us through this Site cannot be guaranteed.

a)     You may choose to restrict the collection or use of your personal information in the following ways:

                                      i.        If you would like access to the personal information about you that we may have in our possession, please contact us using the contact information in Section 10 below.

                                     ii.        You may also contact us at the contact information below to correct or update personal information about you in our possession. Please keep in mind that we may have a legal right or obligation to preserve personal information as it currently exists.

                                    iii.        If you would like to stop receiving marketing or promotional communications via email from Cloudbench, you may opt out of such communications by Clicking “Unsubscribe” via a link or using the contact information below. Nonetheless, we will still send you emails relating to the support, administration, and security of our products and services.

  1. Requests for Deletion

a)     Subject to certain exceptions set out below, on receipt of a verifiable request from you, we will:

                                      i.        Delete your personal information from our records; and

                                     ii.        Direct any service providers to delete your personal information from their records.

b)    Please note that we may not be able to comply with requests to delete your personal information if it is necessary to:

                                      i.        Complete the transaction for which the personal information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and us; 

                                     ii.        Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity;

                                    iii.        Debug to identify and repair errors that impair existing intended functionality; 

                                    iv.        Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law; 

                                     v.        Comply with any governing Electronic Communications Privacy Act; 

                                    vi.        Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the achievement of such research, provided we have obtained your informed consent; 

                                   vii.        Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us; 

                                  viii.        Comply with an existing legal obligation; or

                                    ix.        Otherwise use your personal information, internally, in a lawful manner that is compatible with the context in which you provided the information.

a)     Our products and services are intended for use by adults 18 years and older. Cloudbench does not market or sell products or services to minors or knowingly collect personally identifiable information from children under the age of thirteen. If you believe that we have inadvertently gathered personal information about a minor, please write. 

  1. Changes to this Statement 

a)     Cloudbench reserves the right to change this Privacy Policy from time to time. We will make changes by posting a revised copy of this policy to our website and social media accounts or, if Cloudbench deems it necessary, by email notice to you. Your continued use of the Cloudbench website, social media accounts, and/or Cloudbench services after such modifications will constitute your: 

                                      i.        acknowledgment of the modified Privacy Policy; and 

                                     ii.        agreement to abide and be bound by the new version of this policy.
